O R D E R
This Criminal Original Petition has been filed to quash the the notification issued under Section 168 of BNSS dated 06.08.2025 on the file of 3rd respondent/Police.
2. The case of the petitioners is that in respect of an immovable property, as there arose a dispute between the private respondents, a complaint was lodged before the Police. The petitioners who are Advocates, appeared before the Police on behalf of the respondents 4 to 6. Subsequently, the Police passed an order restraining both sides from entering into the property as the Revenue proceedings were already initiated. The said order copy appears to have been served on the present petitioners/Advocates who appeared before the Police on behalf of the respondents 4 to 6. Therefore, challenging the same, the petitioners have filed the present petition.
3. It appears that now the proceedings under Section 164 BNSS has been initiated and the same is pending before the revenue authorities. As the order passed by the police under Section 168 of BNSS is no way connected 2/4
with the rights of the petitioners and only the copy of the order has been served on the petitioners, this Court is of the view that no prejudice what so ever would be caused to the petitioners. Further, now the Revenue proceedings has been initiated between the private parties.
4. In such view of the matter, the impugned order at the instance of the petitioners need not be quashed.
5. With the above observations, this Criminal Original Petition is disposed of.
