Respondents Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of Declaration, declaring the order passed by the first respondent in his proceedings exparte order No.14/1/2004/Exports-III 1544, dated 23.03.2004 of forfeiture of E.M.D. (Earnest Money Deposit), a sum of Rs.2,96,928/- is illegal, arbitrary and violative of Article 14 of the Constitution of India and insofar as it relates to forfeiture of Earnest Money Deposit for under utilization without being a law passed under Article 225 of the Constitution of India and in contravention of Articles 109, 110 and 266 of the Constitution of India.
