The petitioner, who was arrested and remanded to judicial custody on 26.08.2025, for the offence punishable under Sections 5 of Explosive Substances, in Crime No.318 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that the defacto complainant is the Sub-Inspector of Police, Anti-Terrorism Squad, Coimbatore. On receipt of secret information regarding the transportation of explosive substances, on 26.08.2025, the defacto complainant and other police officials had gone to Marappalam to Ettimadai service road, near Alpari Hotel and they intervened and tried to stop the vehicle bearing Reg.No.TN 29 DZ 747, the driver of the said car did not stop the car. Subsequently they intercepted another vehicle bearing Reg.No.TN 25 BK 3979 and enquired the driver of the said vehicle. The driver has not given proper explanation and on checking the said vehicle, it was found that 75 boxes each contains 200 Gelatin sticks, were kept in the said vehicle. Further on enquiry with the driver of the said vehicle, one Karthick, his friend Santhakumar and his owner Shabi are also involved in transporting explosive substances and they used to sell it to quarries. Hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is a driver of the vehicle and he has no knowledge about the material transported. Further the place of arrest did not happen as per the prosecution case and prior to the registration of the FIR, this petitioner was arrested in this case. He would further submit that the petitioner is an 2/4
innocent person and he has been falsely implicated in this case. He would also submit that he never indulged in any such activities as alleged and he is ready to abide any condition and he is in judicial custody from 26.08.2025 and prays to enlarge the petitioner on bail.
4. The learned Government Advocate (Crl. Side) would submit that, totally seven accused and the petitioner is A4. He would further submit that the petitioner along with other accused were found in illegal possession of 15000 Gelatin Sticks. He would also submit that, apart from this case, petitioner has no previous cases.
5. Heard both sides and perused the materials available on record.
6. Considering the quantity of contraband involved in the alleged occurrence and also investigation in this case is also pending, this Court is not inclined to grant anticipatory bail to the petitioner.
