This Writ Petition (Criminal) has been filed challenging the Refer Charge Sheet No.28 of 2025, in Order No.647 vide Form No.96, duly issued by the 2nd respondent herein, dated 01.07.2025.

2. The main contention of the petitioner is that despite the earlier directions of this Court dated 27.02.2025 in Crl.O.P.No.5554 of 2025, to file a final report, now the respondent police have filed a negative report.

Admittedly, on earlier occasion, this Court by order dated 27.02.2025 in Crl.O.P.No.5554 of 2025, had directed the respondent police to complete the investigation in Crime No.607 of 2024 and to file a final report within a period of four months. Now, it appears that a negative report has been filed and RCS notice has been served to the petitioner. According to the learned counsel for the petitioner, the RCS Notice dated 01.07.2025 has been served only after the legal notice was sent by the petitioner.

4. At the out set, this Court is of the view that the very writ petition has been misconceived. The petitioner has already received the RCS notice with negative final report. Therefore, if he is so aggrieved, the proper course is to file necessary protest petition and to agitate before the Magistrate and not before this Court.
