This Criminal Original Petition has been filed to call for the records and quash the charge sheet in C.C.No.135 of 2022 on the file of the learned Judicial Magistrate, Ambattur.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the first respondentPolice and perused the materials available on record.

3. On a perusal of the statements recorded under Section 161 (3) Cr.P.C., it is found that there are prima facie materials available to proceed the case further as against the petitioner. The grounds taken by the petitioner are nothing but defence, which can be agitated only during trial. This Court does not find any merit in this criminal original petition.

4. In view of the same, this Criminal Original Petition is dismissed. However, the petitioner is at liberty to take all his defence before the trial court.
