2. The learned Additional Public Prosecutor would submit that the report in RCS/959331/23 was filed before the learned Judicial Magistrate, Coonoor, on 15.09.2023.

3. In view of the above submission, the petitioner is at liberty to work out his remedy in the manner known to law. The learned Judicial Magistrate is directed to serve notice to the petitioner/defacto complainant, and upon receipt of the notice, the petitioner is at liberty to work out his remedy in the manner known to law. The learned Judicial Magistrate is further directed to proceed with RCS in accordance with law.

4. With the above direction, this Criminal Original Petition is disposed of.
