This Writ Petition has been filed to direct the second respondent to furnish with an application for fresh license under PCPNDT Act with respect to petitioner's branches at Kelambakkam by considering the representation dated 28.08.2025 on merits within a time frame.
2. The learned counsel appearing for the petitioner submits that the petitioner is running a Diagnostic Centre in the name and style of Priya Diagnostics and Ultra Sound Centre from the year 1986 and the same was converted into a Private Limited Company. Since it was expanded to multiple branches, a new Company was floated in the name and style of OMR Priya Diagnostic Centre Private Limited, in which, the petitioner's daughter was given shareholding and due to family dispute, there has been disruption in the business operation which had been led to an injunction suit between the petitioner and her daughter, in which, interim injunction was granted.
3. In the meanwhile, the petitioner applied for change of name in respect of PNDT Licences in the petitioner's Diagnostics Centre running at Duraipakkam, Kelambakkam and Kottivakkam vide Application dated
23.04.2025. The petitioner's daughter also filed a writ petition in W.P.No.23023 of 2025 against the petitioner and the same was disposed of by this Court on 29.07.2025 with certain observations. Pursuant to the said order, the second respondent inspected the premises and certain queries were raised which were satisfactorily replied by the petitioner. The petitioner has also paid the online processing fee of Rs.25,000/- in favour of the respondents. However, the respondents refused to furnish the application for the purpose of applying fresh license. Hence, this writ petition is filed.
4. The learned counsel appearing for the petitioner submits that despite the respondents received the online processing fees from the petitioner, the respondents have not provided necessary application form for the purpose of applying fresh license and hence, this Court may direct the respondents to provide the necessary application form to enable the
petitioner to apply fresh license.
5. The learned Government Advocate appearing for the respondents submits that if the petitioner paid the entire fees, the application will be provided and will be considered in accordance with law.
6. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents.
7. In view of the submission made by both sides, this Court directs the respondents to furnish the necessary application form to the petitioner to enable them to apply for fresh license within a period of two weeks from the date of receipt of a copy of this order. On submitting such application form by the petitioner, the same shall be considered by the respondents within a
