ORDER

This Writ Petition has been filed challenging the proceedings in Na.Ka.No.A7/1520510/2023, dated 25.08.2025 passed by the second respondent and quash the same.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. A perusal of the order impugned in this writ petition shows that an appeal lies before the Commissioner of Land Administration within a period of thirty days. Therefore, when an alternative remedy is very much available, the petitioner cannot invoke the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India, unless there are exceptional circumstances warranting such interference.

4. In view of the above, this Writ Petition is not maintainable. However, the petitioner is at liberty to file an appeal before

the first respondent as against the order passed by the second respondent dated 25.08.2025, within a period of two weeks from the date of receipt of a copy of this order. On receipt of such appeal, the first respondent is directed to dispose of the same, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of the appeal, after giving an opportunity of hearing to the petitioner and the counter parties, if any. Till such time, the respondents 2 and 3 are directed to maintain status quo with regard to the possession of the subject property and mutation of the revenue records.

5. With the above observations and directions, this Writ Petition stands dismissed. Consequently, connected miscellaneous petition is closed. No costs.
