O R D E R

This Writ Petition has been filed for a direction directing respondents to take action of the petitioners representation dated 11.12.2024 and 16.09.2025 submitted with regard to survey the land properties comprised in Survey No. 368/2A2 an extent of Hectares 0.32.38, Survey No. 369/2A2 an extent of Hectares 0.13.97, Survey No. 369/2A3 an extent of Hectares 0.18.02 vide Patta No.4945 situated at Kallipalayam village, Annur Taluk, Coimbatore District within registration district of Coimbatore and sub registration district of Ganapathi through a registered partition deed dated 12.03.2024 in Document No. 1876/2024 registered at the office of SRO Ganapathi.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

The case of the petitioner is that he is the owner of the lands comprised in Survey No.368/2A2, measuring an extent of Hectares 0.32.38, Survey No. 369/2A2, measuring an extent of Hectares 0.13.97, and Survey No. 369/2A3, measuring an extent of Hectares 0.18.02 situated at Kallipalayam village, Annur Taluk, Coimbatore District. In order to survey the said lands, he submitted representations before the respondents. However, the respondents did not take any steps to survey the aforesaid lands so far.

In view of the above, the 4th respondent is directed to survey the petitioner's aforesaid lands based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of a copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.

5. With the above directions, this writ petition is disposed of. There shall be no order as to costs.
