(Order of the Court was made by R.SURESH KUMAR, J.) The delay is 330 days, it is opposed by the learned counsel for the respondent who has taken notice.

2. Though some reasons have been stated in support of the petition since the delay is 330 days, we are inclined to allow this petition only on terms, therefore, this petition is ordered on payment of cost of Rs.3,000/- (Rupees Three Thousand only) payable by the petitioner to the respondent within a period of two weeks from the date of receipt of a copy of this order. On such condition, this Civil Miscellaneous Petition is ordered.
