Respondent(s) PRAYER The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Certiorarified Mandamus to call for records and quash the class- II legal Heirship certificate issued in Pa.Mu. 3151/ 2024/A2 dated
21.03.2024 by the Revenue Department, Kanchipuram, in respect of late K.Nagappan, direct the respondents to forthwith cancel all consequential documents, including the General Power of Attorney registered as document No.3811/2024 dated 14.10.2024 and the sale deeds registered as document Nos.3894/2024, 3895/ 2024, 3896/ 2024, 3897/ 2024, and 3898/ 2024, all dated 09.11.2024, before the Kanchipuram Joint I Sub- Registrar office, direct the respondents to conduct a through inquiry into the fraudulent issuance of the class -II legal heirship certificate and the registration of the impugned documents, and to take appropriate action against the erring officials and private respondents.

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus to call for records and quash the Class- II legal heirship certificate issued in Pa.Mu. 3151/ 2024/A2 dated 21.03.2024 by the Revenue Department, Kanchipuram, in respect of late K.Nagappan, direct the respondents to forthwith cancel all consequential documents, including the General Power of Attorney registered as document No.3811/2024 dated
14.10.2024 and the sale deeds registered as document Nos.3894/2024, 3895/ 2024, 3896/ 2024, 3897/ 2024, and 3898/ 2024, all dated 09.11.2024, before the Kanchipuram Joint I, Sub - Registrar Office, direct the respondents to conduct a through inquiry into the fraudulent issuance of the class -II legal heirship certificate and the registration of the impugned documents, and to take appropriate action against the erring officials and private respondents.
2. During the course of arguments, the learned counsel for the petitioner submits that this Court may permit the petitioner to approach the competent Civil Court to challenge the document executed by the private respondents on the basis of the forged legal heirship certificate dated 21.03.2024.
3. As no adverse order is going to be passed against the private respondents, notice to respondent Nos.8 to 10 is dispensed with.
4. Since the relief sought for by the petitioner in the present Writ Petition cannot be granted by this Court, this Writ Petition is dismissed. The petitioner is permitted to approach the competent Civil Court for appropriate relief. On filing of the Civil Suit, for the purpose of computation of limitation, the period spent before this Court in prosecuting the Writ Petition shall stand excluded. The Civil Court concerned is directed to entertain the suit to be filed by the petitioner without insisting on the issue of delay. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed. 20-11-2025 asi
