ORDER

This Transfer Civil Miscellaneous Petition is filed by petitioner/wife seeking transfer of divorce petition in H.M.O.P.No.62 of 2024 filed by the respondent/husband pending on the file of Subordinate Court, Oddanchathiram, Dindigul District to the file of Subordinate Court, 1/4

Pollachi, Coimbatore District.

2. Heard the arguments of learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.

3. According to the petitioner, she is living with her parents at Pollachi, which is 91 kms away from Oddanchathiram. The respondent/husband filed divorce petition in H.M.O.P.No.62 of 2024 before the Subordinate Court, Oddanchathiram, just to harass the petitioner. The petitioner is having a minor child and she finds it very difficult to undertake travel for such a long distance to attend each and every hearing in Subordinate Court, Oddanchathiram. Hence, she filed this transfer petition for the aforesaid prayer.

4. It is settled law that in cases involving matrimonial dispute, the preference shall be given to the convenience of the petitioner/wife.

5. In the case on hand, the petitioner/wife is residing at Pollachi along 2/4

with her aged parents and she is having a minor child. She expressed her difficulty in undertaking such a long travel to Oddanchathiram to attend each and every court hearing. Therefore, by taking into consideration of the convenience of the wife, this Court is inclined to order the above transfer civil miscellaneous petition as prayed for.

6. Accordingly, the Transfer Civil Miscellaneous Petition is allowed. The petition for divorce filed by the respondent/husband in H.M.O.P.No.62 of 2024 pending on the file of the Subordinate Court, Oddanchathiram, Dindigul District, is withdrawn and transferred to the file of Subordinate Court, Pollachi, Coimbatore District. No costs. Consequently, connected civil miscellaneous petition is closed.
