O R D E R

The petitioner, who was arrested and remanded to judicial custody on 21.08.2025, for the offences punishable under Section 123 of BNS related to (under Section 328 of IPC) in Crime No.516 of 2025, on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that the petitioner was found to be in illegal possession of 66 number of tablets of Aspadol. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. The petitioner is ready and willing to abide by any conditions that may be imposed by this Court hence, he prays to grant bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed bail, submitting that the petitioner, along with other accused, illegally administered two tablets of Aspadol to the victim in powdered form by syringe. During the act, the needle tip broke and remained lodged in the 2/5

victim's right hand, causing severe pain, after which the petitioner fled. The victim was admitted to the hospital and later discharged. He further submitted that the petitioner has four previous cases.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the gravity of the offences and bad antecedents, this Court is not inclined to grant bail to the petitioner.
