Defendants This Civil Suit is filed under Order IV Rule 1 of Original Side Rules r/w Order VII Rule 1 of C.P.C., prayed for (a) Permanent Injunction restraining the defendants, their men, agent and any one claiming on their behalf from conducting the election to the office bearers/members of the Managing Committee of the 1st defendant society;

(b) Permanent Injunction restraining the Sub - Committee constituted by the Guidance Committee from enrolling members to the defendant society;

(c) Mandatory Injunction directing to conduct a free and fair election to the office bearers/Managing Committee of the 1st defendant society by appointing a retired Judge of this Hon'ble Court as Election officer to peruse the applications for approval of membership after 07.03.2011 and take a decision in consonance with the bye - law of the 1st defendant society.

JUDGMENT

The learned counsel appearing for the plaintiff seeks permission of this Court to withdraw the Civil Suit and has also made an endorsement to that effect.

In view of the submission and endorsement made by the learned counsel for the plaintiff, the Civil Suit is dismissed as withdrawn, with liberty to file a fresh suit after the declaration of election. Consequently, all other connected applications are closed. There shall be no order as to costs.

The Registry is directed to return the Court fee as per law.
