ORDER

(Order of the Court was made by the Hon'ble S.S.Sundar J.) This writ miscellaneous petition is filed to modify the order dated 11.09.2024 made in W.P.No.27062 of 2024.

2. Though the prayer in the writ petition was for a positive direction, this Court considering the fact that the private respondents should also to be heard, without expressing any opinion on the merits of the case pleaded by the petitioner, directed the second respondent to consider the representation of the petitioner dated 18.06.2024 on merits and in accordance with law and to pass appropriate orders after hearing all the interested persons including the 7th respondent in the writ petition. The nature of the order would indicate that this Court did not go into the merits of the contentions.

3. That apart, the learned Standing counsel for the CMDA has also produced before this Court a proceedings of the Chennai Metropolitan Development Authority dated 13.12.2024 to show that the statutory authority has also taken action against the unauthorised construction put up by the private respondents. In such circumstances, this Court finds no ground to modify the order.

Accordingly, this petition is closed as unnecessary. (S.S.S.R.,J) (P.B.B.,J.) 27.01.2025 gpa
