ORDER

(Order of the Court was made by S.M.Subramaniam J.) Writ of mandamus has been instituted to direct the respondents 4 to 6 institute proceedings under Tamil Nadu Land Encroachment Act, 1905 against the 7 th respondent and to remove the encroachments made by the 7 th

respondent in R.S.No.650/6 Paranchervazhi Village, Kangeyam Taluk, Tiruppur District to enable the petitioner to reach his agricultural lands freely and without any hindrance.

2. Learned Government Pleader appearing on behalf of the official respondent would submit that encroachments are identified in Nilaviyal pathai, which is for public usage.

3. Learned counsel for the petitioner would submit that action has already been initiated, and an appeal preferred under Section 10 of the Land Encroachment Act before District Collector is pending.

4. Under these circumstances, competent authority shall proceed with the appeal and dispose of the same as expeditiously as possible enabling the revenue authorities to remove the encroachment, if any identified.

5. With these observations, the writ petition is disposed of. No costs. Consequently, the connected miscellaneous petitions, if any are closed.
