ORDER
The petitioner, who was arrested and remanded to judicial custody on 22.02.2023 based on execution of NBW dated 19.01.2023 in S.C.No.57 of 2025 on the file of the learned I Additional District and Sessions Judge at Vellore, for the offences punishable under Sections 302, 201 and 120B of IPC in Crime No.295 of 2020, seeks bail.

The learned counsel appearing for the petitioner submitted that the petitioner was arrested and released on bail; that since the petitioner failed to appear before the Trial Court in S.C.No.57 of 2025, a NBW was issued on 19.01.2023 and subsequently, the petitioner was arrested on 22.02.2023. He further submitted that the co-accused/ A3 was already granted bail by this Court, vide order dated 09.07.2025 in Crl.O.P.No.19477 of 2025 and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 3.
The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner submitted that since the petitioner failed to appear before the Trial Court, a NBW was issued and subsequently, he was arrested on 27.03.2025. He further 2/4
submitted that there are totally 8 accused and the petitioner is arrayed as A2 in this case; that the petitioner has previous cases including cases under Section 302 of IPC; and that the stage of the trial is pending for not engaging of counsel by the accused.

Considering the facts of the case, the previous antecedents of the petitioner and taking note of the fact that the trial is kept pending for non-cooperation of the accused by not engaging the counsel for proceeding with the trial, this Court is not inclined to grant bail to the petitioner at this stage.
