Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the first respondent to consider the petitioner's representation dated 29.04.2025 to measuring the petitioner's property bearing survey No.213/3, with an extent of 1.20.0 hectares situated at Kariyakoil Valavu Village and Post, Pethanaicken Palayam Taluk, Salem District.

ORDER
This Writ Petition has been filed seeking a direction to the first respondent to consider the petitioner's representation dated 29.04.2025 and to measure the petitioner's property bearing survey No.213/3, with an extent of 1.20.0 hectares situated at Kariyakoil Valavu Village and Post, Pethanaicken Palayam Taluk, Salem District.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner has a land comprised in survey No.213/3, with an extent of 1.20.0 hectares situated at Kariyakoil Valavu Village and Post, Pethanaicken Palayam Taluk, Salem District. In order to survey the said land, the petitioner submitted an application before the first respondent. So far the first respondent did not take any steps to survey and demarcate the land belongs to the petitioner. Hence, this writ petition.
4. In view of the above, the first respondent is directed to survey 2/4
the petitioner's aforesaid land based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if any, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of copy of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor.
5. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
