This petition has been filed seeking to set aside the ex-parte order dated 16.10.2023 passed in C.S.No.53 of 2022. 2.In the affidavit filed in support of the petition, it had been stated that another counsel appeared for the present applicant and owing to various miscommunications, the applicant was set ex-parte on 16.10.2023. 3.As a matter of fact, the applicant also affirmed the compromise entered into between him and the plaintiff.

4.Taking into consideration all factors, this petition stands allowed. Ex-parte against the applicant / defendant is set aside. 5.Post the matter under the caption "for reporting settlement" on 08.04.2024.
