Sivagovindarajan v. Narayanasamy @ Sekar
C.M.P.No.4525 of 2024 C.M.P.No.4525 of 2024 in A.S.No.135 of 2024 R.SUBRAMANIAN, J.
and R.SAKTHIVEL, J.
The petitioner seeks an order of injunction restraining the respondents from in any manner alienating or encumbering the property subject matter of the suit in O.S.No.39 of 2019 on the file of the I Additional District Court, Tindivanam.
2. The appeal itself has been filed against the dismissal of the suit for specific performance filed by the appellant herein. Any alienation made pending appeal will be subject to the result of the appeal. In the circumstances, we do not see any reason to grant an order for injunction, more so, when the petitioner did not have the benefit of an order of injunction pending trial.
3. Hence, this petition is dismissed.
