The petitioner, who was arrested and remanded to judicial custody on 26.02.2025, for the alleged offence punishable under Sections 395, 450 and 397 of IPC in Crime No.160 of 2017, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that this petitioner was originally arrested and released on bail and during pendency of the committal proceedings this petitioner absconded on 23.08.2021 and non-bailable warrant was issued. Thereafter, he was secured only recently and the case against the petitioner is also split up and the mother case is also pending. Hence, the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and he is in judicial custody from 26.02.2025 and is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that there are ten previous cases pending against the petitioner and he opposed for grant of bail to the petitioner.
5. Heard both sides and perused the materials available on record including the First Information Report.
6. Considering the submissions of the learned counsel on either side, the 2/4
petitioner is absconded nearly four years and committal proceedings yet to be completed and also ten previous cases are pending against the petitioner and this Court is not inclined to grant bail at this stage to the petitioner.
