ORDER

This writ petition is filed to forbearing the 4th respondent herein any manner dispossessing the Petitioners from their patta lands in Survey No. 61B/1A and 61B/3A, measuring an extent of 5.08 acres at Pothanur Village, Kabilar Malai Road, Paramathivelur Taluk, Namakkal district and in Survey No.61B/1A and Survey No.61B/3A, measuring a total extent of 3.79 acres at Pothanur Village, Kabilar Malai Road, Paramathivelur Taluk, Namakkal District without due process of law.

2. Learned counsel for the petitioners would submit that the lands in Survey Nos.61B/1A and 61B/13A, measuring an extent of 5.08 acres and 3.79 acres, respectively at Pothanur Village, Kabilar Malai Road, Paramathivelur Taluk, Namakkal District belongs to petitioners and the patta was also stands on their name. Since 1967, the petitioners and their families are in the possession of the said land. However, the respondents 4 and 5 are trying to dispossess them without following any due procedure of law. Hence, this writ petition.

3. Mr.C.Gowthamaraj, learned Government Advocate takes notice on behalf of the respondents and submitted that the respondents will not take any steps to evict the petitioners, without following the due process of law.

4. Heard the learned counsel on either side and perused the materials available on record.

5. As the petitioners have been in possession of the subject property since 1967, they shall not be evicted without due process of law. Such being the case, this Court directs the concerned respondent to refrain from disturbing their possession except through established legal procedures. With the aforesaid direction, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed. 02-04-2026 Index: Yes/No Speaking/Non-speaking order VM
