ORDER

(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.S.Bruno Cruz, learned counsel for the petitioner; Mr.P.Harish, learned Government Advocate for respondents 1 and 2; and, Mr.V.Kamalakumar, learned counsel for respondents 3 to 5.

2. The petitioner claims that Muthalamman temple is the owner of the property and patta was issued in favour of the private

respondents.

3. The temple in question is not added as party respondent in the present writ petition. The petitioner claims to be a devotee. The petitioner seeks cancellation of patta issued in favour of one Krishnaveniammal for the land in Survey No.27 situated at Kanathur Village.

4. If patta is erroneously issued and the person is aggrieved by it, then a provision exists in the Tamil Nadu Patta Passbook Act to file an appeal. It is for the aggrieved party to avail the appropriate remedy as may be permissible under law.

5. With the above observation, the writ petition is disposed of. There shall be no order as to costs.
