O R D E R

The petitioner, who was arrested and remanded to judicial custody on 09.08.2025 for the alleged offence under Section 296(b), 118(1) of BNS altered to 296(b), 105 of BNS in Crime No.252 of 2025 on the file of the respondent police, seeks bail.

2. The case of prosecution is that the petitioner is the son of 1/4

the defacto complainant's brother. A-2 is the mother and A-3 is the wife of the petitioner. There is land dispute between the defacto complainant's family and the petitioner's family, due to which there was wordy quarrel between the parties and in the said occurrence, the petitioner and other accused abused the defacto complainant in unparliamentary words and assaulted him with stick and caused injuries to him. However, during the course of treatment on 14.08.2025 she died. Hence, the complaint was registered against the petitioner.

3. The learned counsel appearing for petitioner submitted that the petitioner and he is no way connected with the offence. He would submit that he has not at all committed any of offence as alleged by the respondent police and he has been falsely implicated in this case and he will abide by any condition that may be imposed by this court. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent reiterated the prosecution case and submitted that investigation in this case is not yet completed. He further submitted that this Court has dismissed the earlier bail application filed by the petitioner in 2/4

Crl.O.P.No.24553 of 2025 dated 09.09.2025. Hence, he would vehemently opposed to grant bail to the petitioner.

Considering the facts, gravity of offence, there is no change of circumstances after dismissal of the earlier bail application of the petitioner in Crl.O.P.No.24553 of 2025 and the investigation is pending, this Court is not inclined to grant bail to the petitioner. 6.
