Apprehending arrest in connection with Crime No.1072 of 2024, registered for the offences punishable under Sections 123 of BNS r/w Section 24(1) of COTPA Act, the present petition has been filed seeking anticipatory bail.
2.The case of the prosecution is that the respondent police arrested the accused for the illegal possession of 14 Kg. of banned Tobacco products. Hence, the case.
3.Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this court. He further submits that the based on the confession of the co-accused, the petitioner herein has been roped in this case. He is no way connected with the alleged occurrence. He would further submit that petitioner is ready to abide by any stringent condition that may be imposed by this Court. 4.The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for
grant of anticipatory bail, is that the respondent police arrested the accused for the illegal possession of Tobacco products weighing 14 Kgs. A1 has been arrested in this case and confession statement has been recorded. He would further submit that there are four previous cases pending as against the petitioner.
5.Having heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record.
6.Taking into consideration the above facts and circumstances of the case and the submission made by the learned Government Advocate, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this Criminal Original Petition stands dismissed. 10.12.2024 ah
