ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 420 & 34 of IPC, in Crime No.111 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the accused, by running an unregistered chit, received a sum of Rs.2.59 Crores and returned a sum of Rs.1.32 Crores and cheated the defacto complainant by not returning the balance amount. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner and A1 are known to each other and other than that the petitioner has no role in the case.

4. The learned Government Advocate (Crl. side) would submit that the accused have cheated the defacto complainant to the tune of Rs.1.3 crores by running an unregistered chit. He would further submit that A1 has been arrested and he has confessed that the entire amount has been transferred to the account of the petitioner herein, who has purchased properties in Coimbatore and Bangalore and further the petitioner is also running a unregistered chit and finance company in

Coimbatore.

5. The learned counsel for the intervenor/defacto complainant would submit that the petitioner is the father of A1. A1 has transferred the amounts to the petitioner's account and the petitioner has also purchased properties in Coimbatore and Bangalore and they are evading payments.

6. Taking into consideration the facts and circumstances of this case, this Court is not inclined to grant anticipatory bail to the petitioner.
