CMP.No.28913 of 2024 in CMA.SR.No.166241 of 2024 M.DHANDAPANI, J.

This petition has been filed seeking to condone the delay of 910 days in filing the above appeal.

2. Mr.Chendur Eashwaran, learned counsel takes notice on behalf of the 1st and 3rd respondents.

3. Learned counsel for the petitioner submitted that, during the pendency of this petition, the 2nd respondent passed away, however, the legal heirs of the deceased 2nd respondent are already on record.

3. In view of the above, no further steps needed to be taken for bringing on record the LRs of the deceased 2nd respondent.

4. Heard learned counsel on either side.

5. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to order this petition.

6. Accordingly this petition is allowed. Registry is directed to number the appeal, if it is otherwise in order and post the matter for admission on 31.01.2025.
