ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.113 of 2020 dated 19.02.2020 for the alleged offence under Section 448, 294(b), 353, 506(1), 143 and 341 of I.P.C. This case and the splitup case in C.C.No.120 of 2025 arising out of the raising out of the same crime number. The allegation is that all the accused gathered together and wear shouting and also threatening the police and even when the police sought to pacify them and put reason to them, they again threatened to hurt them and also to give false complaint against them and they prevented them from carrying on their duty. For the said allegation the case is pending from the year 2020. Summons has not been served consequently warrant pending.

shl 3.Considering the factual matrix, context of the case, the background of the accused, the reason for absence from her usual place, and the submission that, despite best efforts, the warrant could not be executed, it is evident that even if the accused is brought to face trial, it would impinge upon her right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

4.Accordingly, the case in CC.190/2025 on the file of the JUDICIAL MAGISTRATE COURT NO.2, Nagapattinam Taluk, Nagapattinam stands quashed. This Suo Motu Transfer Case is disposed of. 14.10.2025 electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
