This application has been filed by the applicant/3rd defendant to condone the delay of 18 days in filing the written statement in the above suit.

2. The learned counsel for the 1st respondent/plaintiff has no objection in allowing this application.

3. Having satisfied with the reasons stated in the affidavit filed in support of the application and in order to give a fair opportunity to the applicant/3rd defendant to contest his case on merits, the delay is condoned and accordingly, this application is allowed.

4. At the request of the learned counsel for the 1st defendant, post on 09.02.2024.
