ORDER

The petitioner, who was arrested and remanded to judicial custody on 07.07.2025, for the offences punishable under Section 308(5) of BNS in Crime No.314 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 13.08.2025 in Crl.O.P.No.22590 of 2025. 2.

The case of the prosecution is that the petitioner along with other accused came to the house of the defacto complainant; that thereafter threatened the defacto complainant and her husband and taken away her car and cell phones. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence and he is in judicial custody since 07.07.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner has 11 previous cases; that it is the petitioner, who contacted the victim and taking help of the other accused, committed the crime; and that the investigation is pending. 5.

Considering the facts, gravity of offence, the previous antecedents of the petitioner, there is no change of circumstances after dismissal of the earlier bail application of the petitioner in Crl.O.P.No.26830 of 2025 and the investigation is pending, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 26.09.2025 stn 3/4
