ORDER

This petition has been filed to set aside the conditional order clause (iv) made in Crl.MP.No.01/2024 in CA.No.42/2024 dated 08.02.2024 on the file of the Principal District and Sessions Court, Coimbatore.

2. The Appellate Court, while suspending the sentence passed under Section 138 of Negotiable Instruments Act in C.C.No.1010 of 2017, directed the petitioner to deposit 20% of the compensation amount and also directed the petitioner to appear before the Trial Court on the first working day of every English calendar month at 10.30 a.m.

3. The learned counsel for the petitioner submitted that the above amount is deposited by the petitioner. He further submits that considering the age of the petitioner, which is about 75 years, the condition to appear before the Trial Court may be modified.

4. Considering the fact that the appeal has already been filed, directing the petitioner to appear before the Trial Court is not correct. Hence, the petitioner is directed to appear before the Appellate Court in all the hearing dates.

5. With the above direction, this petition is allowed. Consequently, connected miscellaneous petition is closed.
