JUDGMENT

(Judgment of the Court was made by S.M.SUBRAMANIAM, J.) The writ order dated 05.06.2023 passed in W.P.No.14810 of 2023 is under challenge in the present writ petition. The writ petitioner is the appellant before this Court. The writ petition was instituted seeking a direction to the first respondent to consider the representation of the petitioner dated 06.03.2023. The writ Court has considered the issues on merits and found that the school building situate in Government Poramboke land was in dilapidated condition and the Authorities have demolished the building and constructed a new building for the benefit of the school children. The learned Government Advocate appearing on behalf of the

respondents 1 to 4 would submit the photographs, which would reveal that new building has already been constructed. The Temple in existence has not been disturbed. The land is a Government Poromboke land. 5.

That being the factum, the appellant has no right and thus the relief as such sought for to dispose of the representation would not arise at all. Even for considering such relief, the person approaching the Court has to establish right or infringement of right. Thus, the Writ Appeal is devoid of merits and stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
