Respondents PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to consider the representation of the petitioners dated 04/09/2025 in the light of the orders passed in W.P.No.6037/2024 dated 07.03.2024 regarding allotment of houses to the petitioners, who have been originally residing at 2nd respondents pulianthope Housing Board sites, migrated from Pulianthope to Vyasarpadi under the assurance of providing alternative residential houses, within a time frame to be fixed by this Honourable Court.

O R D E R

The impartial meted out to the similarly placed petitioners by the respondents by trying to evict them from the premises, by not adhering to their promise has resulted in the filing of the present petition.

2. Since separate court fee has been paid by the petitioners, W.M.P.No.42539 of 2025 which has been filed seeking to permit the petitioners to file a single Writ Petition is ordered as prayed for.

3. Respective learned standing counsel appearing for the 1st and 2nd respondents accepts notice and submits that this Court may pass appropriate orders.

4. It is the case of the petitioners that they are slum dwellers and daily labourers, who were residing at Pulianthope and upon the assurance of the 2nd respondent that on construction of flats, they would be provided with occupation and that they have been shifted to a place, temporarily, which is opposite to a cremation ground, without any basic amenities. However, the petitioners were Page No:4/6

under the impression that they would be provided with tenaments as assured, but they were not given. Since the respondents are not trying to keep up their assurance, some of the residents approached this Court by filing W.P. No.6037/2024 directing to provide alternative housing to the persons and based on the said order, the petitioners, who are also similarly placed gave a representation to the respondents dated 4.9.2025, however no order has been passed on the said representation, which has prompted the petitioners to file the present petition.

5. This Court heard the learned counsel appearing on either side and perused the materials available on record.

6. In view of the limited relief sought for, this Court, without going into the merits of the issue, directs the respondents to consider the representation of the petitioner dated 4.9.2025 and pass appropriate orders taking into consideration the order passed in W.P.No.6037/2024 by this Court in respect of similarly situated persons, in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

7. This writ petition is disposed of with the aforesaid directions. There shall be no order as to costs.
