For Petitioner :
Mr.B.Balavijayan For Respondents :
Mr.Syed Mustafa Special Government Pleader (Puducherry) C O M M O N O R D E R (Order of the Court was made by R.SURESH KUMAR, J.) These writ petitions have been filed against the orders passed by the Central Administrative Tribunal, Chennai Bench in O.A.Nos.1033 and 1035 of 2023 dated 21.11.2023.
2. It is peculiar to note that the order of the Tribunal dated 21.11.2023 posting the matter for hearing on 06.02.2023 is under challenge. To have a ready reference of the matter, the order impugned herein is extracted hereunder in entirety.
"MA filed by the applicants seeking permission to join together in single O.A. is allowed.
Respondents are directed to file reply returnable by four weeks. Post the matter before Registrar for completion of pleadings. Post the matter before Bench on 06.02.2023"
3. Heard Mr.B.Balavijayan, learned counsel for the petitioners. He submitted that the recruitment process is going on and therefore the petitioners sought for an interim order urgently. However, without considering the said urgency since the Tribunal has adjourned the matter to 06.02.2023, before which if the recruitment is over, the rights of the petitioners would be at stake. Therefore, he sought for the 2/4
indulgence of this Court against the order of adjournment passed by the Tribunal impugned herein and also he seeks for a further order from this Court to keep one post to be reserved, for which the recruitment is already on, pending disposal of the O.As.
4. We are not impressed with the arguments advanced by the learned counsel for the petitioners as, what are the merits of the main O.A., is not the matter to be decided by this Court in these writ petitions, since the order of adjournment passed by the Tribunal dated 21.11.2023 alone is under challenge. The Tribunal has adjourned the matter to 06.02.2024 (wrongly typed as 06.02.2023 in the orders) for hearing. Before 06.02.2024 if the matter has to be heard due to urgency, it is open for the petitioners to file a miscellaneous application for advancing the hearing. Instead of resorting to the same since the petitioners have approached this Court challenging the order of adjournment, we are not inclined to entertain these writ petitions.
5. For the aforesaid reasons, these writ petitions are dismissed. No costs. Consequently connected miscellaneous petitions are also closed. (R.S.K.,J.) (K.B.,J.) 09.01.2024 Internet : Yes/No 1/2 KST Note : Issue order copy today (09.01.2024) 3/4
