Side) COMMON ORDER The petitioners, who apprehend arrest at the hands of the respondent police for the offence under Section 6(4) of Tamil Nadu Scheduled Commodities [RDCS] Order, 1982 and 7(1)(a)(ii) of Essential 1/4

Commodities Act, 1955 in Crime No.173 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioners is that the petitioners are ranked as A1 and A2 and they allegedly joined together collected huge quantity of 11,000 kgs of PDS Rice, which was meant for public distribution and transported the same without any valid licence or permit to the Bangarupet (Karnataka State) and thereby involved in smuggling of the PDS rice. On police investigation, A3/Sankar, driver of the vehicle was arrested and on his statement, the role of A1/Kaja Moideen, owner of vehicle and A2/Rajesh also involved in smuggling were revealed. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners have been falsely implicated in this case based on the confession of A3 and they are not involved in any offence as alleged in the FIR. Hence, he prayed to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal side) for the respondent police reiterated the prosecution case and reported that there are totally three accused in this case and that the petitioners are ranked as A1 and A2. Co-accused A3 was arrested and other persons were absconded. He further submitted that investigation in this case is still pending and A1/Kaja 2/4

Moideen is concerned, he is having two previous cases and A2/Rajesh is concerned, no previous case registered against him. Hence, he opposed to grant anticipatory bail to the petitioners.

Considering the above facts and circumstances of the case, taking note of the submission made by the learned Government Advocate (Crl.Side), previous bad antecedents and also the fact that huge quantity of PDS rice has been involved and investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioners.
