O R D E R Aggrieved by the legal heirship certificate dated 14.10.2024 issued by the 2nd respondent, the petitioner is before this Court.
2. Mrs.S.Anitha, learned Special Government Pleader takes notice on behalf of respondents 1 & 2.

It is the case of the petitioner that his representation dated 03.08.2025 to the 2nd respondent seeking removal of his in-laws name from the legal heirship certificate dated 14.10.2024 which was issued in respect of his deceased wife, was not considered by the respondents. Hence, the petitioner has come up with the present Writ Petition challenging the legal heirship certificate dated 14.10.2024.

Learned counsel appearing for the petitioner submitted that the impugned legal heirship certificate issued by the 2nd respondent is wholly arbitrary and illegal as no proper enquiry was conducted before issuing the same thereby denying the petitioner the opportunity of hearing to putforth his explanation which is in violation of principles of natural justice and therefore, the impugned legal heirship certificate is liable to be interfered with so as to enable the authority to rectify the same.

Learned Special Government Pleader appearing for the respondents fairly submitted that the legal heirship certificate dated 14.10.2024 which was issued in respect of the petitioner's deceased wife will be reconsidered by the respondents and that an appropriate legal heirship certificate will be issued to the petitioner.

In the light of the aforesaid submissions, the impugned legal heirship certificate dated 14.10.2024 issued by the 2nd respondent is hereby set aside and the matter is remanded back to the 2nd respondent for fresh consideration. The 2nd respondent is directed to conduct appropriate enquiry between the parties and issue a fresh legal heirship certificate to the petitioner in respect of his deceased wife within a period of two weeks from the date of receipt of a copy of this order.
7. The Writ Petition is allowed in the above terms. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed. 17.10.2025 Index : Yes / No Speaking Order / Non-speaking order Nhs 3/4
