(Order of the Court was made by R.SUBRAMANIAN, J.) Mr. K.G.Senthilkumar, learned counsel appears for respondents 1 and 3 to 9.

2. It is stated that the second respondent is no more. The Tribunal has held that the second respondent is not a dependent of the deceased and it is not granted any compensation to him.

Hence we see no necessity for impleading the legal heirs of the deceased second respondent in this CMP.

3. Accepting the reasons assigned in the affidavit filed in support of this petition, this petition is ordered and the delay of 486 days in filing the Appeal is condoned.
