ORDER

The petitioner, who was arrested and remanded to judicial custody on 30.07.2025 for the alleged offence under Section 103(1) & 238 of BNS Act, 2023 in Crime No.728 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner, along with two other accused and the deceased, used to consume liquor together. On 29.07.2025 at about 10.00 p.m., while accused A1 to A3 were consuming 1/4

liquor near a water body, the deceased arrived and repeatedly demanded liquor from the petitioner. When the petitioner refused and the deceased continued to disturb them, the petitioner, along with the other accused, allegedly pushed the deceased aside and assaulted him using a liquor bottle, subsequently stabbing him, which resulted in his death. Thereafter, they burned the body. Following the incident, the petitioner appeared before the respondent police and gave a statement, based on which the case was registered and the body was recovered.

The learned counsel for the petitioner submitted that the petitioner, who has been arrayed as A3 was not involved in the incident, that incidence occurred due to a sudden quarrel and the petitioner did not commit the murder of the deceased. He further submitted and that the petitioner, along with others, only assaulted the deceased and subsequently left the scene of occurrence. He further submitted that the petitioner is in continuous incarceration from 30.07.2025 and prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and reported that totally 2/4

there are three accused in this case and that the petitioner is ranked as A3. He further submitted that the petitioner, not only attacked the deceased with liquor bottles subsequently, burned the body and also buried the same. He further submitted that investigation in this case is not completed. Hence, he opposed to grant bail to the petitioner.

5. Considering the overt act attributed against the petitioner and the manner in which the murder had taken place, this Court is of the view that granting bail at this stage is not proper. Hence, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 14.10.2025 ssi To:
