Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the fifth respondent to issue Site Visit Certificate to the petitioner for the e-tender notice issued by the fourth respondent vide No.24/2025-26/SE/B (C & M) C/SLM dated 18.08.2025 and consequently permit the petitioner in the e-tender dated 18.08.2025 issued by the fourth respondent. The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the fifth respondent to issue Site Visit Certificate to the petitioner for the e-tender notice issued by the fourth respondent vide No.24/2025-26/SE/B (C & M) C/SLM dated 18.08.2025 and consequently permit the petitioner in the e-tender dated 18.08.2025 issued by the fourth respondent. 2.The learned counsel appearing for the petitioner submitted that the petitioner is the Managing Partner of M/s.Phoenix and Co. and 2/6
the petitioner is doing several projects for the Government as well as private respectively for construction of buildings. On 18.08.2025, the fourth respondent issued e-tender notice inviting e-tenders for construction of 6 Class rooms in Government Girls Higher Secondary School under NABARD RIDF XXXI for the year 2025 - 2026 at Neikarapatti in Salem District. The bids were called for from 25.08.2025 to 10.09.2025 and the same was subsequently extended to 18.09.2025 and the bid was scheduled to be opened on 18.09.2025 at 3.30 p.m. The petitioner made application for issuance of Site Visit Certificate before the fifth respondent on 03.09.2025 and since it was not issued, the petitioner was not able to upload the said certificate along with application for e-tender.
3.The learned counsel appearing for the petitioner further submitted that the bids were not yet opened. Hence, this Court may issue direction to the fifth respondent to issue Site Visit Certificate to the petitioner so as to enable the petitioner to upload the said certificate along with application for e-tender. 4.The learned Special Government Pleader submitted that the last date for submission of e-tender was 18.09.2025, whereas, the 3/6
petitioner has filed this writ petition only on 23.09.2025. Hence, this writ petition cannot be entertained.
5.Since the writ petition has been filed after the end date for submission of e-tender, even if Site Visit Certificate is issued to the petitioner, no useful purpose would survive. Hence, this Court is not inclined to grant the relief sought for in this writ petition. 6.The writ petition is dismissed. No costs.
