Crl.M.P.No.684 of 2024 in Crl.A.SR.No.63640 of 2023 M. NIRMAL KUMAR , J The petitioner as complainant had filed a private complaint against the respondent for offence under Section 138 of the Negotiable Instruments Act in C.C.No.4 of 2022 before the learned Judicial Magistrate, Fast Track Court at Magisterial Level, Tiruvannamalai. The Trial Court by judgment dated 31.05.2023, dismissed the complaint and acquitted the respondent, against which, he preferred the above appeal with a delay of 133 days.
2.Private notice taken to the respondent has been served on 05.02.2024 and the respondent name is also printed in the causelist. Despite the same, there is no representation for the respondent today, which shows that the respondent has got no serious objection in condoning the delay.
3.In view of the above, the delay stands condoned and the petition is ordered.
