This petition has been filed to condone the delay of 98 days in filing the above appeal.

2. Though initially the learned counsel for the respondent requested time for filing counter, subsequently, he would submit that any appropriate order may be passed by this Court.

3. Being satisfied with the reasons assigned by the petitioner and for the interest of justice, this Court is inclined to allow this petition.

4. Accordingly, this petition is allowed and the delay of 98 days in filing the appeal is condonned.

5. The Registry is directed to print the name of Mr.M.E.Ilango, learned counsel appearing for the respondent while listing the above appeal.
