ORDER

The petitioner seeks direction to comply the order of the Judicial Magistrate No-II, Chengalpattu in Crl.MP.No.4266 of 2024 dated 05.11.2024.

2. It is the case of the petitioner that the third respondent cheated the petitioner to a sum of Rs.10,24,464/- and CSR has been registered and thereafter, no action has been taken by the respondent Police. Hence, he filed Crl.MP.No.4266 of 2024 before the Judicial Magistrate No-II, Chengalpattu. The judicial Magistrate vide order dated 05.11.2024 directed the respondent Police to hold preliminary enquiry as held in Lalitha Kumari case and if cognizable offence is made out, directed to register FIR and file the report. However, no action has been taken so far and hence, the present petition.

3. The learned Government Advocate [Criminal Side] on instructions submitted that enquiry will be completed within a month. The said statement is recorded

In view of the submissions of the learned Government Advocate [Criminal Side] appearing for the respondent, there shall be a direction to the respondent Police to complete the enquiry within a period of one month. Further, as directed by the learned Magistrate, if any cognizable offence is made out, the respondent Police shall register FIR and thereafter, file final report before the concerned Magistrate.

5. With the above directions, this Criminal Original Petition is disposed of.
