Respondents Prayer: Petition filed under Section 11 of the Contempt of Courts Act, to punish the respondents for disobeying the order dated 24.08.2023 made in W.A.No.2539 of 2022.

ORDER

(Order of the Court was made by the Hon'ble Acting Chief Justice) This Contempt Petition has been filed for the alleged disobedience of the judgment dated 24.08.2023 passed by this court in W.A.No.2539 of 2022.

2. When this Contempt Petition was taken up, the learned Government Pleader appearing for the respondents submitted that the judgment of this Court dated 24.08.2023 in W.A.No.2539 of 2022 has been complied with. In support of the same, he has produced a letter dated 25.04.2024, wherein, it is inter alia stated as follows:- "9. Hence, the records including the decisions taken by Government vide letter dated 10.02.2021 were again reconsidered. If age relation is to be granted to appellants Tmt.Pachammal and others, then there are 30,121 persons who had worked on a temporary basis in Valar Kalvi Thittam of School Education Department (on consolidated pay) on grounds of parity seek similar consideration.

This apart, there are many hundreds of persons working on a temporary basis on consolidated pay under various other Government Schemes / Departments. They would also make identical claims for age relaxation and lateral entry. Such age relaxation or lateral entry would defeat the purpose of the scheme and surely open the Pandora's box. Hence, the decision taken by the Government earlier is confirmed.

10. Therefore, it is regretfully informed that no age relaxation or lateral entry can be granted. However, it is reiterated that if the appellants apply for the post of Noon Meal Organizer, as and when a recruitment notification is issued, their application would be considered on merits and as per the extant rules."

3. The aforesaid submission made on the side of the respondent authorities has been fairly conceded by the learned counsel for the petitioners.
