Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to conduct an enquiry based on the petitioner's application dated 22.05.2023 for providing assistance of shelter and protection for his life as per the Maintenance and Welfare of Parents and Senior Citizens Act 2007 and the Tamil Nadu Maintenance 1 / 4

and Welfare of Parents and Senior Citizens Rules 2009 by giving sufficient notices and opportunities to the private respondents herein and conclude the same within a time stipulated by this Court.

O R D E R

The prayer sought for herein is for a Writ of Mandamus directing the 2nd respondent to conduct an enquiry based on the petitioner's application dated 22.05.2023 for providing assistance of shelter and protection for his life as per the Maintenance and Welfare of Parents and Senior Citizens Act 2007 and the Tamil Nadu Maintenance and Welfare of Parents and Senior Citizens Rules 2009 by giving sufficient notices and opportunities to the private respondents herein and conclude the same within a time stipulated by this Court.

2. The second respondent has entertained an appeal under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act 2007 and the rules made thereunder.

3. The writ petitioner seeks for a Mandamus to dispose of the said petition within a stipulated time. Being a statutory duty that has to be performed by the second respondent, there shall be a direction to dispose of the petitioner's petition dated 22.05.2023 within a period of twelve (12) weeks from the date of receipt of a copy of this order. The writ petition is disposed of with the above direction. No costs.
