Heard the learned counsel on either side.

Though there is a delay of 751 days in re-presentation of the above first appeal in A.S.SR.No.107572 of 2023, on going through the affidavit of the petition and after hearing the learned counsel appearing for the petitioner, I am satisfied that the petitioner has made out sufficient cause of explanation for the delay in re-presenting the first appeal papers.

4. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed and the delay in re-presenting the above first appeal is condoned.

5. The Registry is directed to number the appeal, if it is otherwise in order and list the same for admission.
