ORDER
(Order of the court was made by the Hon'ble Chief Justice) We have heard Mr.T.Deeraj, learned counsel appearing for M/s.PV Law Associates, learned counsel for the petitioner; and Mr.T.K.Saravanan, learned Government Advocate for respondents 1 to 3.
2. It is the contention of the petitioner that the impugned notice has been issued to a dead person Raman.
3. It is not disputed by learned counsel for the petitioner that the legal heirs would be entitled to the property.
4. It is submitted that the property belongs to the petitioner Sangam. The sale deed is in favour of the Sangam.
5. Patta No.850 is issued in the name of Raman and the notice in question is only a show cause notice. According to the petitioner, the petitioner Sangam has right over the property.
6. If the petitioner Sangam has right over the property, it may reply to the show cause notice. Before passing final orders, the respondent authorities shall consider the reply that may be filed by the petitioner to the show cause notice.
7. The writ petition, as such, is disposed of. There shall be no order as to costs. Consequently, W.M.P.No.36376 of 2023 is closed.
