ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. This case, Cr.No.34 of 2006 is registered for alleged offence under Section 379 of Indian Penal Code, 1860. This occurrence is of the year 2006. The property involved is 29 grams of Gold. At that point of time, cash of Rs.18,000/- was recovered and handed over to the defacto complainant. However, the defacto complainant expressed his objection for the case being closed. It can be seen that at the relevant point of time, almost the entire value of the gold has been recovered and the case is pending now for almost 19 years. It is represented on behalf of the police that, in spite of the best efforts, the accused remains elusive and there is absolutely no clue to trace out the accused.

3. In view thereof, this is an extraordinary case for invocation of powers under Article 226 of the Constitution of India, to close the case with liberty to the prosecution to reopen and continue the matter if the accused resurfaces or if any clue about the accused is received.

4. With such liberty, the case in C.C.No. 12087 of 2007 on the file of VIII Metropolitan Magistrate Court, George Town Taluk, Chennai shall stand closed and this Suo Motu Transfer Case stand disposed of. 14.10.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
