2.W.P.No.19053 of 2025 has been filed seeking issuance of Writ 4/11
of Certiorarified Mandamus, calling for the records of the first respondent vide his proceedings in Se Mu Na. Ka. No.3398/A1/ 2024 dated 16.05.2025 and quash the same.
3.W.P.No.23890 of 2025 has been filed seeking issuance of Writ of Certiorarified Mandamus, to call for records of first respondent in proceeding in Che.Mu.Na.Ka.No.3398.A1/2024 dated 26.05.2025 and quash the same and consequently direct the first respondent lift the temporarily suspended order dated 26.05.2025 by restoring the order dated 16.05.2025 passed by the first respondent. 4.Since the issue involved in these writ petitions relates to dispute between father and son, the writ petitions are heard together and disposed of by way of a common order. For brevity, the petitioner in W.P.Nos.38910 of 2024 and 19053 of 2025 would be hereinafter referred to as 'son' and the petitioner in W.P.No.23890 of 2025 would be hereinafter referred to as 'father'. 5.The learned counsel appearing for the petitioner in W.P.Nos.38910 of 2024 and 19053 of 2025/ son submitted that the father out of love and affection executed settlement deed 5/11
no.3150/2008 dated 28.03.2008 registered on the file of Sub Registrar Office, Thiruvottiyur in Book - I in favour of son and thereafter at the instigation of his daughter Mythili filed petition against the son before the Maintenance Tribunal, Revenue Divisional Officer, North Chennai praying to cancel the said settlement deed and the Revenue Divisional Officer vide proceedings dated 24.10.2024 cancelled the settlement deed executed by the father in favour of the son and aggrieved by the same, the son filed W.P.No.38910 of 2024. Thereafter, the father preferred appeal before the District Collector and the District Collector vide proceedings dated 16.05.2025 directed the son to vacate the house and aggrieved by the same, the son filed W.P.No.19053 of 2025.
6.The learned counsel appearing for the petitioner in W.P.No.23890 of 2025/ father submitted that the father executed settlement deed and Will in favour of son and in Will there is a condition that the father reserve his rights during lifetime and is entitled to cancel the Will. Due to the act of the son, the father filed petition seeking to cancel the settlement deed inorder to give some protection to his grand daughter and the Revenue Divisional Officer vide proceedings dated 24.10.2024 cancelled the settlement deed and 6/11
challenging the said order, the son filed W.P.No.38910 of 2024 and this Court vide order dated 19.12.2024 granted an order of interim stay, pursuant to which, the District Collector vide proceedings dated 26.05.2025 temporarily suspended the order dated 16.05.2025 directing the son to vacate the house and aggrieved by the same, the father filed W.P.No.23890 of 2025.
7.Heard both side and perused the materials available on record.
8.Perusal of records disclose that the father executed settlement deed no.3150/2008 dated 28.03.2008 registered on the file of Sub Registrar Office, Thiruvottiyur in respect of 7684 sq.ft. of property in favour of son and since the son refused to take care of the father, the father made complaint before the Revenue Divisional Officer and the Revenue Divisional Officer vide proceedings dated 24.10.2024 directed the son to enjoy the 7684 sq.ft. of property which he acquired through settlement deed no.3150/2008 dated 28.03.2008 and to vacate the premises in respect of 4756 sq.ft. of property which was settled in favour of one Saranya/ grand daughter of the father vide settlement deed no.393/2024 dated 22.01.2024 and further 7/11
directed the son to maintain the father till his lifetime, in default, proposal will be sent to cancel settlement deed no.3150/2008 dated 28.03.2008.
9.Perusal of records further disclose that the father preferred appeal before the District Collector on 10.12.2024 and the District Collector vide proceedings dated 16.05.2025 directed the son to vacate the premises in respect of 4756 sq.ft. of property which was settled in favour of one Saranya/ grand daughter of the father and further directed the son to maintain the father till his lifetime, in default, proposal will be sent to the concerned Sub Registrar Office to cancel the settlement deed no.3150/2008 dated 28.03.2008. The District Collector further ordered that if any disturbance is caused for the father if he resides in the premises belonging to Saranya, action will be taken by the law enforcing agency.
10.Perusal of records further disclose that challenging the proceedings of the Revenue Divisional Officer dated 24.10.2024 the son filed W.P.No.38910 of 2024 and this Court vide order dated 19.12.2024 granted an order of interim stay. Hence, the District Collector vide proceedings dated 26.05.2025 temporarily suspended 8/11
the order dated 16.05.2025.
11.The father executed settlement deed and Will in favour of son. The settlement deed is an irrevocable settlement deed without any condition and in Will there is a condition that the father reserve his rights during lifetime and is entitled to cancel the Will and the father executed settlement deed no.393/2024 dated 22.01.2024 in favour of one Saranya/ grand daughter of the father. The Revenue Divisional Officer and the District Collector have not cancelled the settlement deed executed in favour of the son. They have only directed the son to take care of his father till his lifetime by providing food, shelter and other necessities and to vacate the premises in respect of 4756 sq.ft. of property which was settled in favour of one Saranya/ grand daughter of the father.
12.In view the above, the proceedings of the Revenue Divisional Officer dated 24.10.2024 and the proceedings of the District Collector dated 16.05.2025 warrants no interference. The writ petitions filed by the son are dismissed and the writ petition filed by the father stands disposed of.

13.With the above observations, the writ petitions in W.P.Nos.38910 of 2024 and 19053 of 2025 are dismissed and the writ petition in W.P.No.23890 of 2025 stands disposed of. No costs.
