ORDER

The respondent/wife has filed present petition seeking transfer of H.M.O.P.No.4145 of 2024, pending on the file of VI Additional Family Court, Chennai to the Family Court at Coimbatore. 2.The above H.M.O.P.No.4145 of 2024 has been filed by the respondent/husband before the VI Additional Family Court, Chennai seeking a decree of divorce. The petition has filed the present petition seeking transfer of the case to the Family Court at Coimbatore, on the following grounds:- (a)The petitioner is presently residing at Coimbatore along with her children and has no independent source of income. (b)The respondent/husband has not given any maintenance either to the petitioner/wife or to his children, thereby causing severe financial 2/5

hardship.

(c)Since the matter is pending before the Family Court, Chennai, the petitioner will have to appear for every hearing all the way from Coimbatore.

3. Considering the distance, the petitioner will have to stay over in Chennai and all of this would be an additional financial burden on her, particularly, since the husband has not given any maintenance. Considering the above facts, in the interest of justice, it would be proper, the transfer is effected and the transfer as prayed for in this petition is ordered. Hence, this Transfer Civil Miscellaneous Petition is allowed and the case in H.M.O.P.No.4145 of 2024 pending on the file of the VI Additional Family Court, Chennai is withdrawn and transferred to the Family Court, Coimbatore. Consequently, connected Miscellaneous Petition is closed. No costs.
