PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, directing the respondents 1 and 2 to produce the body or person of the petitioner's minor daughter Harshini aged about 13 years immediately who is in the custody of the third respondent, before this Court and hand over her custody to the petitioner. ORDER
(Order of the Court was made by M.S.RAMESH,J.) The petitioner's daughter, who was a minor aged about 13 years, went missing from her mother's house on 16.12.2023. Therefore, the petitioner lodged a complaint on the very same day before the second respondent police, which has been registered as 'Girl Missing'. In this background, the present Habeas Corpus Petition has been filed.
2.Learned Additional Public prosecutor submitted that the petitioner was secured from the custody of the third respondent herein, against whom a complaint has been registered. Apart from this, another case has also been registered against him for the offences, which includes an offence under the POCSO Act, for which, he was arrested and remanded to judicial custody.
3. In connection with the complaint given by the petitioner with regard to her missing daughter in Cr.No.943 of 2023, the second respondent police have also traced the petitioner's daughter and produced her before us. When we interacted with her, she expressed that she intends to rejoin and live with her mother, the petitioner herein.
4.Since the grievance of the petitioner has been redressed, no further orders are required to be passed in this petition.
